Still With You is a deeply personal product. We want every family to have clear, honest expectations about what it is, what it is not, and what determines the quality of your experience. This disclaimer constitutes a legally binding agreement between you and Still With You. Please read it in full before backing, downloading, installing, or using the product.

1. What You Receive

Still With You is delivered as software with generic default settings and no personal content. The product ships with:

— Zero personal memories. No voice recordings, no family stories, no photos, no videos, no personality data of any kind.
— Default personality settings. Generic warmth, humor, and communication parameters that have not been tailored to any specific person.
— A small set of sample wisdom memories. These are generic placeholder messages included to demonstrate the memory system. They are not personal to anyone.
— No pre-trained voice model. Voice cloning requires you to provide your own audio recordings of the person being preserved.

The product is a framework and set of tools. The personal experience is created entirely by you and your family through the setup and ongoing configuration process described below.

2. Tier-Specific Features

Still With You is sold in four tiers. Each tier includes a specific, fixed set of features. Features available in higher tiers are not available in lower tiers. The following table summarizes key feature differences:

Feature availability is permanently determined by the tier purchased and cannot be changed, upgraded, or unlocked after delivery. Features not included in your tier are not present in the software delivered to you. Tier upgrades are not available after the campaign ends.

3. Your Results Depend Entirely on Your Input

The quality, accuracy, and emotional impact of your Still With You experience is determined by the effort, time, and materials you invest. Specifically:

Voice Cloning Quality

The synthesized voice is only as good as the recordings you provide. Clear, high-quality audio with minimal background noise, recorded in a quiet environment, produces the best results. Recordings with heavy background noise, music, echo, compression artifacts, multiple overlapping speakers, or very short duration will produce lower-quality or potentially unrecognizable voice output. We cannot and do not guarantee any specific level of voice fidelity or recognizability. We include audio preprocessing tools and a quality analyzer, but these tools have limits. If the only available recordings are of poor quality, the resulting voice may not sound like the intended person. There is no minimum quality threshold we can promise.

Memory Content

The system can only recall and reference information that has been entered into it. If you seed the system with 10 memories, it has 10 memories to draw from. If you seed it with 500, it has 500. The richness, accuracy, and depth of conversations are directly proportional to the quantity and quality of memories you provide. A sparsely populated system will produce generic, shallow responses that do not reflect the preserved person's actual personality, knowledge, or manner of speaking.

Personality Configuration

The system's default personality is generic. Adjusting the personality sliders (warmth, humor, sarcasm, playfulness, empathy, formality) and configuring per-person communication styles is essential to making the system feel like a specific individual. Without deliberate personality tuning, the system will not sound like your loved one. It will sound like a generic AI with their voice.

Media and Milestones

Life milestone messages and video attachments must be created or customized by you. Pre-seeded templates provide starting points but require personal editing to be meaningful. If no milestone messages are written or customized, no meaningful milestone messages will be delivered. The emotional power of milestones comes from words and recordings that a real person took the time to create.

Ongoing Engagement

The system learns from conversations over time, but it also benefits from ongoing memory additions, corrections, and refinement. Families who actively engage with the memory editor, correct inaccurate responses, and add new memories will see a continuously improving experience. Families who set it up once and never revisit the configuration will have a static, potentially stale experience.

4. AI Limitations

— This is not a real person. Still With You uses artificial intelligence to simulate conversation. It does not possess consciousness, emotions, understanding, or awareness. It is a software system that generates responses based on statistical patterns and the data you provide. It does not "know" or "feel" anything.
— The AI will sometimes be wrong. It may say things the preserved person would never have said, use phrases that don't match their speech patterns, generate factually incorrect information, contradict previously stated memories, or handle emotional moments inappropriately. No amount of configuration eliminates this possibility entirely. These are inherent and unavoidable limitations of current AI technology.
— Voice cloning is an approximation. The synthesized voice will resemble the person but is not identical. Careful listeners will notice differences in tone, inflection, emotional expression, and naturalness. The technology produces a recognizable likeness at best, not a perfect reproduction. Results vary significantly based on input quality.
— AI technology evolves and may degrade. The underlying open-source AI models may be updated, deprecated, or superseded by their respective communities. While the system operates offline, future software updates may change behavior. We do not guarantee that system behavior will remain consistent across versions or that updates will improve performance.
— Facial and voice recognition have error rates. The system may fail to recognize a family member, misidentify one person as another, or fail to detect faces in certain lighting conditions. Anti-spoofing measures reduce but do not eliminate the possibility of false positives. No biometric system is infallible.

5. Not a Substitute for Professional Support

Still With You is not therapy, counseling, grief support, mental health treatment, medical advice, or a substitute for any form of professional care. It is a technology product that preserves conversational interaction. It does not diagnose, treat, advise on, or manage any mental health or medical condition. It is not designed, tested, or certified for therapeutic use.

Interacting with an AI representation of a deceased loved one may be comforting for some and deeply distressing for others. The emotional impact of using this product is unpredictable and may change over time. We strongly recommend consulting with a licensed mental health professional or grief counselor before and during use, particularly for:

• Individuals in the acute stages of grief
• Children and adolescents of any age
• Individuals with a history of depression, anxiety, PTSD, or other mental health conditions
• Families where members disagree about using the system
• Individuals who may develop unhealthy attachment to or dependence on the system

Still With You, its creators, officers, employees, affiliates, and licensors accept no responsibility whatsoever for any emotional, psychological, psychiatric, relational, or physical outcomes resulting from use of the product, whether direct or indirect, foreseeable or unforeseeable. Use is entirely at your own discretion and risk.

6. No Guarantees of Outcome

We do not and cannot guarantee:

— That the system will sound like, behave like, or feel like your loved one
— That the voice clone will be recognizable to family members
— That conversations will be emotionally satisfying, comforting, or therapeutic
— That the system will respond accurately, appropriately, or consistently in all situations
— That the product will meet your specific expectations, needs, or emotional requirements
— That the product will function without bugs, errors, data loss, or interruptions
— Any specific level of voice fidelity, personality accuracy, conversational quality, or emotional impact
— That AI-generated responses will be factually correct, contextually appropriate, or free from bias
— That the product will be suitable for your particular family, emotional, or psychological circumstances
— That updates or new features will improve your experience or maintain backward compatibility

Demonstrations, screenshots, videos, and testimonials shown in marketing materials represent a system that has been extensively configured with hundreds of memories, high-quality voice recordings, and months of personality tuning by the developer's own family. Your results will vary based on the time, effort, and quality of input you provide and may differ substantially from what is shown in any marketing, promotional, or demonstration materials.

7. Software Provided "As Is"

STILL WITH YOU IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

THE ENTIRE RISK AS TO THE QUALITY, PERFORMANCE, AND RESULTS OF THE SOFTWARE REMAINS WITH YOU. SHOULD THE SOFTWARE PROVE DEFECTIVE, YOU ASSUME THE COST OF ALL NECESSARY SERVICING, REPAIR, OR CORRECTION.

IN NO EVENT SHALL STILL WITH YOU, ITS CREATORS, OFFICERS, EMPLOYEES, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, EMOTIONAL DISTRESS, PSYCHOLOGICAL HARM, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE PRODUCT, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE, OR ANY OTHER LEGAL THEORY, AND REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THIS AGREEMENT OR YOUR USE OF THE PRODUCT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR SPECIFIC TIER LICENSE. THIS LIMITATION APPLIES REGARDLESS OF THE NUMBER OF CLAIMS, THE BASIS OF THE CLAIM, OR THE NATURE OF THE DAMAGES SOUGHT.

8. Indemnification

You agree to indemnify, defend, and hold harmless Still With You, its creators, officers, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the product; (b) your violation of this disclaimer or any applicable law; (c) any content you enter into the system, including memories, voice recordings, and media; (d) any claim by a third party related to the voice, likeness, or personal information of the person being preserved; (e) any emotional, psychological, or relational harm alleged to result from use of the product by you or any person you permit to use it; or (f) your failure to obtain appropriate consent for use of another person's voice, likeness, or personal data.

9. User Responsibility

By using Still With You, you acknowledge and accept that:

— You are solely responsible for all content entered into the system, including memories, voice recordings, photos, videos, and milestone messages.
— You are responsible for obtaining appropriate consent to use the likeness, voice, and personal information of the person being preserved, in compliance with applicable laws in your jurisdiction, including but not limited to right of publicity, personality rights, and data protection regulations.
— You are responsible for the wellbeing of all individuals who interact with the system, particularly children, elderly persons, and vulnerable individuals.
— You are responsible for your hardware. We do not manufacture, sell, or warranty any hardware. Any hardware purchased based on our recommendations is your responsibility. Hardware failures, compatibility issues, or damage are not covered by our support.
— You are responsible for data backups. While the system stores data locally, hardware failure, theft, fire, water damage, or other events can result in permanent, irrecoverable data loss. We are not responsible for lost data under any circumstances.
— You accept the inherent limitations of AI as described in this disclaimer and agree not to hold Still With You liable for any AI-generated content, whether accurate or inaccurate, appropriate or inappropriate.

10. Use by Children

While Still With You includes features designed for children (age-adaptive communication, parental alerts, crisis detection), adult supervision and judgment are essential. The parental alert system is a supplementary tool, not a guarantee of child safety. It may miss concerning content, produce false positives, or fail to detect issues that a present adult would catch. It is not a substitute for parental supervision.

Parents and guardians are solely responsible for determining whether this product is appropriate for their children, at what age to introduce it, and how to contextualize the experience. We strongly recommend involving a child psychologist or family therapist in decisions about using AI-based memorial technology with children.

We accept no liability for any psychological, emotional, developmental, or behavioral effects on children resulting from their interaction with the system, whether supervised or unsupervised.

11. For Campaign Backers

Crowdfunding pledges (whether on Kickstarter, Indiegogo, or any other platform) are contributions to a creative project, not purchases of a finished product. While we have a working system and intend to deliver on all described features, backing a crowdfunding campaign carries inherent risk. Delivery timelines, feature scope, and final specifications may change during development. The respective platform's terms of use govern the backer-creator relationship.

Marketing materials, campaign videos, and demonstrations represent the current state of a system that has been configured by its developer over an extended period. They reflect what the product is capable of with significant investment of time and personal content -- not what you will experience out of the box.

Refunds after delivery of digital licenses are not available. Once a software license has been delivered and activated on your hardware, the transaction is considered complete. Dissatisfaction with the quality of AI-generated output, voice cloning results, or conversational experience does not constitute grounds for a refund, as these outcomes depend on user-provided input as described in this disclaimer.

12. Ethical Use

Still With You is designed exclusively for preserving the memory of loved ones within a family or close personal relationship. You agree not to use the product to:

• Impersonate any living person without their explicit written consent
• Create deceptive content, deepfakes, or fraudulent communications
• Harass, manipulate, stalk, or deceive any individual
• Violate any applicable law, regulation, or third-party rights
• Commercially exploit, resell, sublicense, or redistribute the software or any output it generates

We reserve the right to revoke software licenses for verified misuse without refund.

13. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Any dispute, claim, or controversy arising out of or relating to this disclaimer, the product, or your use of the product (collectively, "Disputes") shall be resolved through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, rather than in court. There is no judge or jury in arbitration, and court review of an arbitration award is limited.

CLASS ACTION WAIVER: You and Still With You agree that each party may bring Disputes against the other only in an individual capacity and not as a plaintiff or class member in any purported class, consolidated, or representative action. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding.

JURY TRIAL WAIVER: You and Still With You hereby waive any constitutional and statutory rights to sue in court and have a trial in front of a judge or a jury.

The arbitration shall be conducted in the State of Colorado, United States. The arbitrator's decision shall be final and binding. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

14. Governing Law

This disclaimer and any Disputes arising from your use of Still With You shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions. To the extent that arbitration is found inapplicable or unenforceable, any legal action or proceeding shall be brought exclusively in the state or federal courts located in the State of Colorado, and you consent to the personal jurisdiction of such courts.

15. Force Majeure

Still With You shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemic, epidemic, war, terrorism, government actions, embargoes, sanctions, supply chain disruptions, power failures, internet outages, hardware component shortages, changes in third-party AI model availability or licensing, or any other event beyond our reasonable control. In the event of a force majeure, delivery timelines shall be extended by the duration of the delay.

16. Severability and Entire Agreement

If any provision of this disclaimer is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction or arbitrator, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

This disclaimer, together with the crowdfunding campaign page and reward tier descriptions, constitutes the entire agreement between you and Still With You regarding the subject matter hereof. It supersedes all prior or contemporaneous oral or written communications, proposals, and representations with respect to the product. No modification of this disclaimer shall be binding unless in writing and signed by Still With You.

17. Acknowledgment

By backing this project on any crowdfunding platform, downloading, installing, or using Still With You in any capacity, you acknowledge that you have read and understood this disclaimer in its entirety and agree to be bound by its terms.

You understand and agree that:

• The product is delivered with generic settings and no personal content
• Features are determined by and limited to the tier you purchased
• The quality of your experience depends entirely on what you provide
• No specific outcome, level of satisfaction, or emotional benefit is guaranteed
• The product is not therapy, counseling, or a substitute for professional care
• You accept the binding arbitration and class action waiver provisions
• You accept all risks associated with use of AI-based memorial technology
